Acceptable Use

This Acceptable Use Policy (this "Acceptable Use Policy" or "AUP") forms part of, and is incorporated by reference into, the Onedash Terms of Service (the "Terms"). Capitalised terms used in this Acceptable Use Policy but not defined here have the meanings given to them in the Terms. This Acceptable Use Policy governs how Customer and its Authorised Users may use the Onedash Services, and Customer is responsible for ensuring that all Authorised Users comply with it.

If there is an actual conflict between this Acceptable Use Policy and the Terms, the Terms will control unless expressly stated otherwise. Nothing in this Acceptable Use Policy permits conduct that is prohibited by applicable law or by the terms of a third-party service accessed through Onedash.

1. Proper Use

Customer must, and must ensure that all Authorised Users, use the Services only for lawful purposes and in accordance with the Terms, this Acceptable Use Policy, applicable law, and any applicable third-party terms.

Onedash may restrict, suspend, or deny access to all or part of the Services where reasonably necessary to enforce this Acceptable Use Policy or the Terms, protect the Services or other users, respond to a security risk, comply with law, or prevent unlawful or abusive activity. Where reasonably practicable, Onedash may provide notice before restricting or suspending access, but is not required to provide advance notice where immediate action is reasonably necessary for security, legal, operational, or abuse-prevention reasons.

Onedash is not responsible for Customer's or an Authorised User's use of the Services in violation of this Acceptable Use Policy, the Terms, applicable law, or applicable third-party terms.

2. Restrictions

2.1 General Restrictions

Customer must not, and must not encourage, promote, facilitate, instruct, or permit any other person to, use the Services for any illegal, harmful, abusive, deceptive, or unauthorised purpose. Without limiting the foregoing, Customer must not use the Services to:

  • (a) violate any applicable local, state, territory, provincial, national, or international law, regulation, court order, or legally binding requirement;
  • (b) create, upload, transmit, distribute, or facilitate viruses, malware, ransomware, spyware, worms, Trojan horses, logic bombs, malicious scripts, or other harmful or disruptive code;
  • (c) engage in phishing, credential theft, impersonation, fraud, forgery, scams, misappropriation, social engineering, or other deceptive conduct;
  • (d) infringe, misappropriate, or violate another person's intellectual property, confidentiality, privacy, publicity, contractual, or other legal rights;
  • (e) exploit, abuse, endanger, groom, or otherwise harm minors, or collect, use, disclose, or store information relating to minors in violation of applicable law;
  • (f) impersonate another person or entity, falsely represent an affiliation, misrepresent the origin of information, or use another person's account or credentials without authorisation;
  • (g) remove, alter, conceal, or obscure copyright, trademark, attribution, security, legal, or proprietary notices included in the Services;
  • (h) bypass, disable, interfere with, defeat, or circumvent authentication, access controls, security controls, rate limits, usage restrictions, device restrictions, licensing controls, or other protections applied by Onedash or a third-party service;
  • (i) perform vulnerability scans, penetration tests, port scans, network probes, packet interception, credential attacks, or other security testing against Onedash infrastructure without prior written authorisation from Onedash;
  • (j) reverse engineer, decompile, disassemble, derive, reconstruct, adapt, modify, or attempt to discover source code, underlying algorithms, non-public APIs, protocols, or technical mechanisms of the Services except to the limited extent such restriction is prohibited by applicable law;
  • (k) use non-public Onedash technology, documentation, interfaces, confidential information, or other proprietary materials to develop, train, benchmark, or operate a competing product or service except where expressly authorised by Onedash;
  • (l) disrupt, degrade, overload, flood, attack, or interfere with the availability, integrity, operation, or performance of the Services or any system or network connected to them, including through denial-of-service attacks or intentionally excessive automated activity;
  • (m) access or attempt to access accounts, devices, systems, networks, sessions, data, or resources that Customer is not authorised to access;
  • (n) use Onedash to access, operate, automate, manipulate, or interact with a third-party service in a manner that violates that service's terms, security controls, access restrictions, or applicable law;
  • (o) use multiple accounts, sessions, proxies, network configurations, automation, or other Onedash functionality for the purpose of evading bans, suspensions, access controls, geographic restrictions, security restrictions, rate limits, or enforcement measures imposed by a third-party service;
  • (p) use the Services to scrape, harvest, crawl, extract, automate, or systematically collect information from a third-party service where that activity is prohibited by law, the third party's terms, or applicable access controls;
  • (q) buy, sell, share, distribute, use, or facilitate the use of stolen, compromised, fraudulently obtained, or otherwise unauthorised credentials, tokens, sessions, cookies, authentication material, or account access;
  • (r) use the Services to operate an open proxy, open mail relay, malicious redirector, command-and-control service, botnet infrastructure, credential-stuffing infrastructure, or other service primarily intended to facilitate abusive or unlawful activity;
  • (s) use the Services to create, store, transmit, or distribute content that is unlawful, defamatory, fraudulent, exploitative, or that promotes or facilitates serious unlawful harm;
  • (t) use the Services to stalk, threaten, intimidate, harass, abuse, or facilitate targeted harm against another person;
  • (u) use, export, re-export, transfer, or make available the Services, software, technical information, or other controlled material in violation of applicable export control or sanctions laws; or
  • (v) use the Services in a way that is materially inconsistent with their intended operation, imposes an unreasonable or disproportionately large load on Onedash infrastructure, or creates a material security, legal, or operational risk for Onedash or other users.

2.2 Third-Party Services

Onedash enables Customer to access and manage third-party websites, applications, accounts, and services. Customer remains responsible for complying with the terms, policies, restrictions, and legal requirements applicable to those third-party services. The ability to access a third-party service through Onedash does not mean that Onedash authorises Customer to bypass or disregard that third party's requirements. Customer must have all rights, permissions, licences, accounts, and authorisations necessary to access and use each third-party service through Onedash.

Onedash may restrict or disable functionality relating to a third-party service where reasonably necessary to address abuse, legal requirements, security concerns, compatibility issues, or restrictions imposed by the third-party service.

2.3 Restriction of Content

Where Customer Data or other content stored or processed through Onedash violates this Acceptable Use Policy, the Terms, applicable law, or the rights of another person, Onedash may restrict access to, disable, quarantine, or remove the affected content where reasonably necessary. Onedash is not required to monitor all Customer Data or third-party content and does not assume responsibility for Customer's content merely because it is processed through the Services.

3. Communications

3.1 Unsolicited Communications

Customer must not use the Services, directly or indirectly, to send, facilitate, manage, or support spam or other unlawful unsolicited communications. Where Customer uses a third-party email, messaging, telecommunications, social media, or communications service through Onedash, Customer remains solely responsible for complying with all laws, consent requirements, anti-spam requirements, opt-out requirements, and third-party terms applicable to those communications.

Customer must not knowingly use the Services to:

  • (a) send commercial electronic messages where the required consent or other lawful basis has not been obtained;
  • (b) send messages to addresses, numbers, or accounts obtained through unlawful harvesting, scraping, credential theft, or other unauthorised means;
  • (c) disguise, falsify, or materially misrepresent the sender or source of a communication;
  • (d) send communications after a recipient has validly exercised an applicable unsubscribe, opt-out, STOP, do-not-call, or equivalent right; or
  • (e) use the Services to facilitate phishing, scams, fraud, impersonation, or other deceptive communications.

3.2 Consent and Authorisation

Customer is responsible for obtaining any consent, permission, licence, opt-in, or other authorisation required before contacting another person or processing that person's information through a third-party communications service accessed using Onedash. Customer is also responsible for maintaining records of consent where required by applicable law.

4. Security and Account

Customer is responsible for maintaining the security of Customer's Account, devices, credentials, authentication factors, sessions, and Authorised Users. Customer must promptly notify Onedash if Customer becomes aware of unauthorised access to Customer's Account, compromised credentials, misuse of the Services, or another security issue that may affect Onedash or other users. Customer must not knowingly allow a suspended, terminated, unauthorised, or malicious person to access the Services through Customer's Account.

5. Enforcement Action

Onedash may investigate actual or suspected violations of this Acceptable Use Policy. Where Onedash reasonably determines that Customer or an Authorised User has violated this Acceptable Use Policy, the Terms, applicable law, or created a material security or operational risk, Onedash may:

  • (a) warn Customer or an Authorised User;
  • (b) require Customer to stop or remediate the relevant activity;
  • (c) restrict particular functionality;
  • (d) block or disconnect an affected device or session;
  • (e) suspend an Authorised User or Account;
  • (f) remove or restrict access to prohibited Customer Data where appropriate;
  • (g) terminate the Account or Agreement in accordance with the Terms; or
  • (h) take any other action reasonably necessary to protect Onedash, its users, third parties, or the integrity and security of the Services.

Onedash may take immediate action without prior notice where Onedash reasonably believes delay could result in unlawful activity, fraud, security compromise, harm to another person, disruption of the Services, or legal liability.

6. Customer Responsibility

Customer is responsible for Customer Data, Customer's use of the Services, and the acts and omissions of Customer's Authorised Users. Customer is responsible for any loss, damage, charges, penalties, fees, claims, or liabilities resulting from Customer's violation of this Acceptable Use Policy to the extent provided by the Terms and applicable law, including charges, penalties, fees, or enforcement consequences imposed by a third-party service provider as a result of Customer's use of that third-party service through Onedash. The indemnification provisions of the Terms apply to claims arising from Customer's violation of this Acceptable Use Policy.

7. Policy Updates

Onedash may update this Acceptable Use Policy from time to time to reflect changes to the Services, security requirements, abuse patterns, legal requirements, or third-party service requirements. Where a change is material, Onedash will take reasonable steps to provide notice through the Services, by email, through the Onedash website, or by another reasonable method. Customer's continued use of the Services after an updated Acceptable Use Policy takes effect constitutes acceptance of the updated Acceptable Use Policy, subject to any rights that cannot be excluded under applicable law.
